The quote may be fictitious -- I took it from the movie Gettysburg -- but it captures a lot of what is now happening in American culture.&lt;br /&gt;&lt;br /&gt;With cries for "states rights" and "secession" again being voiced, we may well wonder exactly how far we've come since April, 1865.&lt;br /&gt;&lt;br /&gt;I wonder if we can &lt;em&gt;&lt;strong&gt;all &lt;/strong&gt;&lt;/em&gt;agree on two things:&lt;br /&gt;&lt;br /&gt;1) Slavery is intrinsically evil and any and all attempts to abolish it were and are justified.&lt;br /&gt;2) Reconstruction after the Civil War was also evil in that it did nothing to "bind up the wounds" but rather was designed to exact vengeance.&lt;br /&gt;&lt;br /&gt;...probably not...but it's about as close as we can come.&lt;br /&gt;&lt;br /&gt;What's the solution?&lt;br /&gt;&lt;br /&gt;The answer was there at Appomattox and in Washington: Grant's terms for surrender and Lincoln's directives to "Let 'em up easy."&lt;br /&gt;&lt;br /&gt;IF these two procedures had been followed, then maybe we would not still have "different dreams."&lt;br /&gt;&lt;br /&gt;Now, I'm a "dyed in the wool" Northerner -- Union Blue to the corps [sic]. I would have fought with the First Maryland [USA] against the First Maryland [CSA] on Culp's Hill at Gettysburg.&lt;br /&gt;&lt;br /&gt;But doesn't mean I look at the officers and enlisted men of the CSA as I do the Nazi SS! I'd see them the way we now regard the German a Japanese soldiers of WWII. [One of my college professors even came to befriend the the Zero pilot who led the attack on Pearl Harbor! He was the guy who's book was the basis for Tora Tora Tora.]&lt;br /&gt;&lt;br /&gt;I still and always will look at the "peculiar institution" embodied in the CSA as I still as always will look at &lt;em&gt;Das Drittes Reich&lt;/em&gt;...inherently evil. But the institution and the people in it are not necessarily equivalent. [Remember, Robert E. Lee, Longstreet and Pickett all opposed slavery!]&lt;br /&gt;&lt;br /&gt;To make the distinction symbolically clear: I [remember: me=Union guy] can honor the Confederate Battle flag and abhor the CSA's political flag. It's not a stretch! It's exactly what was done at Appomattox, when the union troops saluted Lee and his troops! I figure if the Union troops themselves could honor their adversaries, so can I. It's exactly what Lincoln advised in order to bind up the wounds -- to let 'em up easy. Note that it's not racist speech; it's tasteless speech. Racist speech would include something to the effect that Obama SHOULD OR SHOULD NOT be successful because he was an African-America.&lt;br /&gt;&lt;br /&gt;There were no "&lt;span id="SPELLING_ERROR_3" class="blsp-spelling-error"&gt;shoulds&lt;/span&gt;" in Reid's comment; there were only "is-es." He was making a factual assertion, &lt;em&gt;not&lt;/em&gt; an evaluative judgment.&lt;br /&gt;&lt;br /&gt;He was making a truth claim. [By the way, Obama himself, agreed with him! I pretty much want to make the same protestation that &lt;span style="color:#3333ff;"&gt;"music is music"&lt;/span&gt; with the same message in mind. However, rather than expand on this latter truism, I want to venture another, perhaps more controversial, equation, namely that "&lt;span style="color:#3333ff;"&gt;music&lt;/span&gt; is &lt;span style="color:#ff0000;"&gt;writing&lt;/span&gt;" and "&lt;span style="color:#ff0000;"&gt;writing&lt;/span&gt; is &lt;span style="color:#3333ff;"&gt;music&lt;/span&gt;"!&lt;br /&gt;&lt;br /&gt;Oh sure the "grammar" of each is expressed in different terminology, but they mean the same thing.&lt;br /&gt;&lt;br /&gt;Both use symbols as the basic mode of expression (&lt;span style="color:#ff0000;"&gt;words&lt;/span&gt; and &lt;span style="color:#3333ff;"&gt;notes&lt;/span&gt;) and rely on an underlying structure (&lt;span style="color:#ff0000;"&gt;grammar&lt;/span&gt; and &lt;span style="color:#3333ff;"&gt;notation&lt;/span&gt;).&lt;br /&gt;&lt;br /&gt;The basic elements of music are &lt;span style="color:#3333ff;"&gt;melody, harmony and rhythm&lt;/span&gt;.&lt;br /&gt;&lt;br /&gt;The basic elements of writing are &lt;span style="color:#ff0000;"&gt;genre, story and meter&lt;/span&gt;.&lt;br /&gt;&lt;br /&gt;An engaging sentence (in any kind of writing) has a lyrical quality that blends in with the message being conveyed and does so with a satisfying accented.&lt;br /&gt;&lt;br /&gt;An engaging riff (in any kind of music) has a stylistic quality that expresses a purpose in the piece as a whole and does so with a satisfying beat.&lt;br /&gt;&lt;br /&gt;So, can any good writer be a good musician -- and vice versa? Hmmmmm.......&lt;br /&gt;&lt;br /&gt;Oh yes...I forgot...these siblings only share &lt;em&gt;&lt;strong&gt;one&lt;/strong&gt;&lt;/em&gt; parent. The other is unique to each: music has the ears and writing has the eyes. Their common parent? I'm "Robert" and they are "Roger Sr." and "Roger Jr." respectively. They're both scientists...I'm a bull-&lt;span id="SPELLING_ERROR_1" class="blsp-spelling-error"&gt;shitter&lt;/span&gt; [a.k.a. philosopher] and an author [soon to be a &lt;em&gt;world-famous&lt;/em&gt; author -- see...a bull-&lt;span id="SPELLING_ERROR_2" class="blsp-spelling-error"&gt;shitter&lt;/span&gt;, right?]&lt;br /&gt;&lt;br /&gt;Second, I have no intention of saying &lt;em&gt;anything at all&lt;/em&gt; about the science involved in this debate. I'm going to comment on the &lt;em&gt;logic&lt;/em&gt; involved -- or the &lt;span id="SPELLING_ERROR_3" class="blsp-spelling-error"&gt;illogic&lt;/span&gt; as the case may be.&lt;br /&gt;&lt;br /&gt;Third, they get tons more press than I do...and I"m jealous! So I'm hoping to &lt;span id="SPELLING_ERROR_4" class="blsp-spelling-error"&gt;glom&lt;/span&gt; some of their publicity. My two new books coming out in a few months could use it! [&lt;em&gt;&lt;span style="color:#ff0000;"&gt;&lt;strong&gt;A New Birth of Freedom: The Visitor&lt;/strong&gt;&lt;/span&gt;&lt;/em&gt; -- sf/alt history and &lt;span style="color:#ff0000;"&gt;&lt;em&gt;&lt;strong&gt;Rock Music in American History:&lt;/strong&gt; &lt;strong&gt;Stop Children! What's That Sound?&lt;/strong&gt;&lt;/em&gt;&lt;strong&gt;]  &lt;/strong&gt;&lt;/span&gt;See...I'm glomming!&lt;br /&gt;&lt;br /&gt;There's actually a forth reason and probably worth mentioning, since I tend to ramble a bit. My brother got to go to Copenhagen last week for the big Global Warming thing. I would have liked to go to Europe too!! Not for that conference! I would have stopped off in Amsterdam for a legal puff or two! &lt;span id="SPELLING_ERROR_6" class="blsp-spelling-error"&gt;Yaah&lt;/span&gt; &lt;span id="SPELLING_ERROR_7" class="blsp-spelling-error"&gt;mon&lt;/span&gt;!! &lt;span id="SPELLING_ERROR_8" class="blsp-spelling-error"&gt;Rastafari&lt;/span&gt;!&lt;br /&gt;&lt;br /&gt;&lt;span id="SPELLING_ERROR_9" class="blsp-spelling-error"&gt;Ok&lt;/span&gt;...The Global Warming Debate [ahem...]&lt;br /&gt;&lt;br /&gt;Logically, there can only be three positions, it seems.&lt;br /&gt;&lt;br /&gt;1. Human activity has no [or no significant] impact on the climate and thus climate change. My brother tells me these folks are called "climate skeptics" in the trade. What he didn't tell me is that these people are idiots! They're certainly not familiar with rational thought processes! Think about it: in order to VERIFY such a claim, they would have to KNOW ALL POSSIBLE ALTERNATIVES and rule them out-- but that's just not LOGICALLY possible. [You can't know &lt;em&gt;all&lt;/em&gt; possible alternatives because there always may be others you &lt;em&gt;don't&lt;/em&gt; know about -- you can't know what you don't know!! -- LOGIC 101! Verifying a negative proposition is ILLOGICAL.]&lt;br /&gt;&lt;br /&gt;You can FALSIFY this but NOT VERIFY it.&lt;br /&gt;&lt;br /&gt;These people can be ignored...if possible! It seems that Sara &lt;span id="SPELLING_ERROR_10" class="blsp-spelling-error"&gt;Palin&lt;/span&gt; is a prime example of such idiocy [no surprise there]; she recently signed on to this creed. And it would seem to be a mere chimera that we can ignore her. Presumably there are no scientists in this category.&lt;br /&gt;&lt;br /&gt;2. So...that leaves us with the proposition that human activity has SOME significant impact on the climate and climate change, right? This proposition CAN be VERIFIED but NOT FALSIFIED. All it would take is showing ONE example of how human activity can accomplish this. Then it would be shown to be true.&lt;br /&gt;&lt;br /&gt;Now here's where it gets tricky, because there are two very different positions packed into this notion. The word "some" &lt;em&gt;logically and literally&lt;/em&gt; means "at least one and possibly all"! [LOGIC 101]&lt;br /&gt;&lt;br /&gt;2a. The human impact on the environment is pretty much exclusively due to our excess production of carbon dioxide in various ways. Or...to put it a bit more starkly. The human impact on the climate is due only to CO2 pollution. And here there is a LOGICAL problem similar to the "Idiot's Alternative" above: "Exclusivity" can not be verified! You can NOT empirically [a.k.a. show that ONLY ONE thing causes another, because you can not rule out ALL other possible causes -- since you can't know things you don't know! [LOGIC 101 again]&lt;br /&gt;&lt;br /&gt;2b. SO the ONLY LOGICAL alternative is that there is AT LEAST ONE kind of impact humans can have on the climate. Then the issue is to list the possible causes and assess which ones are more or less significant. American troops were/are involved. Obvious, right?&lt;br /&gt;&lt;br /&gt;2. Both were/are unwinnable. Why? Because there's STILL no clear meaning to what "winning" might mean.&lt;br /&gt;&lt;br /&gt;3. American troops did and will inevitably leave -- having not accomplished an elusive "goal."&lt;br /&gt;&lt;br /&gt;4. I would have taken genuine "guts" for a President to say -- in either case -- were not gonna go there!&lt;br /&gt;&lt;br /&gt;&lt;span style="color:#ff0000;"&gt;Differences:&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;1. Vietnam was a "war."&lt;br /&gt;&lt;br /&gt;2. Afghanistan is NOT a "war." Why? Because there no state or nation involved other than the U.S. and there was no "declaration" of war according to the Constitution --no government to surrender to us.&lt;br /&gt;&lt;br /&gt;3. With Vietnam, it was at least arguable that the Viet Cong and the North Vietnamese were RIGHT. [No, maybe not in the way they conducted the war and treated their prisoners...but in their GOAL to unite -- or to preserve the unity of -- Vietnam.]&lt;br /&gt;&lt;br /&gt;4. Al-Qaeda is not necessarily linked to Afghanistan. Breckenridge is poised to clear adults over 21 to have up to 1 ounce of marijuana. &lt;/p&gt;&lt;p itxtvisited="1"&gt;The measure is largely symbolic, though. What a concept! What a &lt;span style="color:#ff0000;"&gt;&lt;strong&gt;crok&lt;/strong&gt;&lt;/span&gt;!&lt;br /&gt;&lt;br /&gt;Don't get me wrong. I have no intention of "dithering" with this iconic notion in any way. For those somewhat unfamiliar with the background of the phrase and the ideal it has come to represent, it was first mentioned as the title of an essay written by John William DeForest, a Civil War novelist, in The Nation magazine on January 9, 1868.&lt;br /&gt;&lt;br /&gt;I need not mention the numerous candidates that have been informally submitted to receive this honorific title, since that's not the point of my asseverations at the moment. What I want to do is allege the "crok-ness" of this idea -- an idea which many have noted is Platonic form to its core. Plato believed that the truly ultimate and perfect "reality" is "formalized" in a reality beyond our sensory dimension -- its forms not ever being achievable in our sensory world.&lt;br /&gt;&lt;br /&gt;So the "ideal" form of "the American Novel" -- in it's platonic sense -- is never achievable in actuality as we know it.&lt;br /&gt;&lt;br /&gt;My problem is this: the very use of this "ideal" suggests that there are criteria (somewhere) that define a "great" novel. If so what are they? And who is responsible for them? What can it &lt;em&gt;&lt;/em&gt;possibly&lt;em&gt;&lt;/em&gt; mean?? I want to suggest that it can &lt;em&gt;&lt;/em&gt;only&lt;em&gt;&lt;/em&gt; mean that a lot of people like it! [Damn, I'm getting old!]&lt;br /&gt;&lt;br /&gt;Anyway, at about 6 pm every weekday evening we were all treated to a half-hour's worth of the "news of the day" [actually a summary of what the editors and writers deemed significant -- their value judgments (but that's another blog)]. It supplemented the daily newspapers. [Remember them?]&lt;br /&gt;&lt;br /&gt;Oh, sure, there are still news shows [emphasis on "shows"] on the major networks each evening -- a half hour of national stuff and a half hour of local stuff. But they're more like entertainment conceits, like US and People magazines.&lt;br /&gt;&lt;br /&gt;Most of the time on TV is allotted to "commentaries" &lt;em&gt;about&lt;/em&gt; the news. Fox comments from the "classical liberal" position, and MSNBC comments from the "utilitarian" position. [Two different perspectives of authentic "liberalism."] CNN sort of does both. BUT THERE'S NO NEWS!&lt;br /&gt;&lt;br /&gt;I must confess, I do enjoy the banter between and among the commentators -- &lt;em&gt;occasionally&lt;/em&gt;!! But I'd sure like to hear the NEWS once in a while.&lt;br /&gt;&lt;br /&gt;What is "news" you many wonder?&lt;br /&gt;&lt;br /&gt;Good question...glad you asked!&lt;br /&gt;&lt;br /&gt;It's the reporting of the important and significant events of the day, a day which was "like all days filled with events that altar and illuminate our times." [If you don't know the quote -- look it up.]&lt;br /&gt;&lt;br /&gt;Can such reporting be objective? Of course not! As I mentioned above, the very selection process is evaluative -- hence subjective. So then, how does this this so-called "reporting" differ from "commentaries" about the news?&lt;br /&gt;&lt;br /&gt;Intent! That's how...the aforementioned, venerable reporters &lt;em&gt;tried&lt;/em&gt; to be "fair and balanced"!&lt;br /&gt;&lt;br /&gt;I miss that...&lt;br /&gt;&lt;br /&gt;Of course I miss The Howdy Doody Show too -- and his friends like Buffalo Bob and Flub-a-Dub, but most of all, Princess Summerfallwinterspring! They seemed bemused.&lt;br /&gt;&lt;br /&gt;It turns out, they didn't see how it was possible to concentrate on such different projects at the same time. When I asked, "What are you talking about, mon ami?" -- Well, I really didn't say this with the Francophilial affectation -- they said something about two &lt;em&gt;contrary&lt;/em&gt; kinds of writing. (An aside: The "logician" in me wants to point out that this is not the same as &lt;em&gt;contradictory &lt;/em&gt;writing -- which is essentially unintelligible.) By this they meant that the mind-set for doing one excludes the other.&lt;br /&gt;&lt;br /&gt;My reply was, "huh?"&lt;br /&gt;&lt;br /&gt;After a bit more reflection, I decided my answer should have been. "What are you talking about. Writing is writing!"&lt;br /&gt;&lt;br /&gt;Hence, this blog...&lt;br /&gt;&lt;br /&gt;I've always assumed that no matter what the subject matter, no matter what the purpose, no matter what the content, you still need to utilize the same language, the same grammar, the same structure!&lt;br /&gt;&lt;br /&gt;There's going to be a "story" of some kind -- even if it's a technical piece on how to put together a kid's bicycle! It's going to have a beginning, a complication, problems to overcome and a dénouement.&lt;br /&gt;&lt;br /&gt;Plus, you've got to make it intelligible and interesting and to the point -- in other words you have to communicate!&lt;br /&gt;&lt;br /&gt;So there. She likens this drama to a family psycho-drama being dealt with by a wise counselor. Just try to define it and you'll see what I mean -- &lt;em&gt;you can't....you betcha you can't!&lt;/em&gt;&lt;br /&gt;&lt;em&gt;&lt;/em&gt;&lt;br /&gt;But back to Wells on Gates-gate: Read it!&lt;div class="blogger-post-footer"&gt;&lt;img width='1' height='1' src='https://blogger.googleusercontent.com/tracker/3179323316617343054-2285616204597524144?l=www.bobpielke.com' alt='' /&gt;&lt;/div&gt;</description><link>http://www.bobpielke.com/2009/07/gates-gate.html</link><author>noreply@blogger.com (Bob Pielke)</author><thr:total>0</thr:total></item><item><guid isPermaLink='false'>tag:blogger.com,1999:blog-3179323316617343054.post-8980781374613924462</guid><pubDate>Wed, 13 May 2009 12:55:00 +0000</pubDate><atom:updated>2009-05-15T06:06:14.428-07:00</atom:updated><category domain='http://www.blogger.com/atom/ns#'>deduction</category><category domain='http://www.blogger.com/atom/ns#'>Conservatives</category><category domain='http://www.blogger.com/atom/ns#'>torture debate</category><category domain='http://www.blogger.com/atom/ns#'>induction</category><category domain='http://www.blogger.com/atom/ns#'>liberalism</category><category domain='http://www.blogger.com/atom/ns#'>deontology</category><category domain='http://www.blogger.com/atom/ns#'>circular reasoning</category><category domain='http://www.blogger.com/atom/ns#'>teleology</category><title>More on the Torture Debate</title><description>&lt;em&gt;sigh......how oh how can people be enticed to THINK!!&lt;/em&gt;&lt;br /&gt;&lt;em&gt;&lt;/em&gt;&lt;br /&gt;There are TWO issues:&lt;br /&gt;&lt;br /&gt;&lt;u&gt;Here's one --&lt;/u&gt;&lt;br /&gt;&lt;em&gt;&lt;/em&gt;&lt;br /&gt;Although I've mentioned this elsewhere in this blog [&lt;a href="http://www.bobpielke.com/2008/12/bad-argument-for-torture-again.html"&gt;http://www.bobpielke.com/2008/12/bad-argument-for-torture-again.html&lt;/a&gt;], the typical "pro-torture" [PT] argument is fatally flawed in that it is invariably presented as a &lt;span style="color:#ff0000;"&gt;&lt;strong&gt;DEDUCTIVE&lt;/strong&gt;&lt;/span&gt; argument when in reality the only possible "PT" argument is &lt;span style="color:#33cc00;"&gt;&lt;strong&gt;INDUCTIVE&lt;/strong&gt;&lt;/span&gt;!&lt;br /&gt;&lt;ul&gt;&lt;li&gt;Given that the only way to prevent innocent lives being lost in a terrorist attack is to torture a terrorist who can reveal the information sufficient to prevent the attack, then torture is justified.&lt;/li&gt;&lt;li&gt;Well, "duh"!!!!&lt;/li&gt;&lt;li&gt;The premise(s) already contains the conclusion!&lt;/li&gt;&lt;li&gt;It's "circular" -- as are &lt;em&gt;&lt;span style="color:#ffff00;"&gt;&lt;strong&gt;all&lt;/strong&gt;&lt;/span&gt;&lt;/em&gt; deductive arguments!!&lt;/li&gt;&lt;li&gt;That's why deductive arguments &lt;em&gt;always &lt;/em&gt;have a conclusion that is certain!&lt;/li&gt;&lt;/ul&gt;&lt;p&gt;The issue is whether ANY of the claims implicit in the premise can be established!&lt;/p&gt;&lt;ul&gt;&lt;li&gt;Why is this only way?&lt;/li&gt;&lt;li&gt;How can we know if the terrorist knows the information?&lt;/li&gt;&lt;li&gt;These questions require EVIDENCE -- hence INDUCTIVE reasoning.&lt;/li&gt;&lt;li&gt;BUT -- we can NEVER know if we have ALL the evidence!&lt;/li&gt;&lt;li&gt;Hence, inductive reasoning can &lt;span style="color:#ffff00;"&gt;&lt;strong&gt;NEVER&lt;/strong&gt;&lt;/span&gt; produce a conclusion with &lt;em&gt;certainty.&lt;/em&gt;&lt;/li&gt;&lt;li&gt;ALL evidentiary claims are MORE OR LESS PROBABLE -- ONLY&lt;/li&gt;&lt;/ul&gt;&lt;p&gt;&lt;u&gt;The other issue is one of morality --&lt;/u&gt;&lt;/p&gt;&lt;p&gt;It's the question as to whether this issue is &lt;span style="color:#3366ff;"&gt;&lt;strong&gt;deontological&lt;/strong&gt;&lt;/span&gt; or &lt;span style="color:#cc33cc;"&gt;&lt;strong&gt;teleological&lt;/strong&gt;&lt;/span&gt;!&lt;/p&gt;&lt;p&gt;1. &lt;strong&gt;&lt;span style="color:#cc33cc;"&gt;Teleological&lt;/span&gt;&lt;/strong&gt; arguments always maintain that the amount of desirable consequences is how we should determine what's right and wrong. [How much good over evil is likely to be produced.]&lt;/p&gt;&lt;p&gt;2. &lt;span style="color:#3366ff;"&gt;&lt;strong&gt;Deontological&lt;/strong&gt;&lt;/span&gt; arguments always maintain that right and wrong are determined by the intrinsic qualities of the act itself -- regardless of the consequences.&lt;/p&gt;&lt;p&gt;Take note -- much of the debate over torture is really a debate over which form of moral reasoning applies!&lt;/p&gt;&lt;p&gt;And...there is NO WAY TO ANSWER THIS DILEMMA!! &lt;/p&gt;&lt;p&gt;Why?&lt;/p&gt;&lt;p&gt;Good question...glad you asked!&lt;/p&gt;&lt;p&gt;It's because when you argue for one of these approaches you MUST MAKE A MORAL ARGUMENT. [We should reason as teleologists!]&lt;/p&gt;&lt;p&gt;Hahahha....but you can't DO this!! A bill of attainder was a legislative act that singled out one or more persons and imposed punishment on them, without benefit of trial. Such actions were regarded as odious by the framers of the Constitution because it was the traditional role of a court, judging an individual case, to impose punishment." William H. Rehnquist, The Supreme Court, page 166.&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;em&gt;&lt;span style="color:#6600cc;"&gt;"Bills of attainder, ex post facto laws, and laws impairing the obligations of contracts, are contrary to the first principles of the social compact, and to every principle of sound legislation. ... The sober people of America are weary of the fluctuating policy which has directed the public councils. They have seen with regret and indignation that sudden changes and legislative interferences, in cases affecting personal rights, become jobs in the hands of enterprising and influential speculators, and snares to the more-industrious and less-informed part of the community." Missouri, 4 Wallace 277 (1866).&lt;br /&gt;U.S. v. Brown, 381 U.S. 437 (1965).&lt;br /&gt;Nixon v. Administrator of General Services, 433 U.S.425 (1977).&lt;br /&gt;Selective Service Administration v. Minnesota &lt;span id="SPELLING_ERROR_4" class="blsp-spelling-error"&gt;PIRG&lt;/span&gt;, 468 U.S. 841 (1984)."&lt;/span&gt;&lt;/em&gt;&lt;br /&gt;&lt;span style="color:#6600cc;"&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:arial;"&gt;Now, the proposed tax would, in effect, &lt;span id="SPELLING_ERROR_5" class="blsp-spelling-corrected"&gt;abrogate&lt;/span&gt; existing contracts.
